Why This Matters
Without clear classification of replicas:
- replicas may be confused with originals
- value may be misrepresented
- authorship may become unclear
- intentional imitation may be mistaken
for reproduction
Minimum Implementation Framework (MIF)
Step 1 — Identify Reference OriginalDefine the original asset being imitated or reconstructed.
Step 2 — Confirm Constructed Nature
Ensure the asset is intentionally created to resemble the original,
not directly reproduced from it.
Step 3 — Define Intent
Establish that the purpose is imitation,
reconstruction, or reinterpretation.
Step 4 — Declare Replica Status
The asset must be clearly identified as a replica.
Step 5 — Define Relationship
The connection to the original must remain identifiable
but must not imply identity.
Use Case 1 — Museum Reconstruction
ScenarioA museum creates a physical reconstruction of a historical object
(e.g. dinosaur, artifact).
Application
The object is classified as a replica.
Result
- original remains protected
- accurate representation is accessible
- no confusion with the original asset
Use Case 2 — Artistic Interpretation
ScenarioAn artist creates a painting inspired by a known artwork
(e.g. reinterpretation of Mona Lisa).
Application
The work is classified as a replica or reinterpretation.
Result
- clear distinction from the original
- new authorship is preserved
- creative freedom remains intact
